The prosecutor assessed the punishment obviously mild

The prosecutor has filed an appeal against the sentence of the Court of First Instance of Erebuni and Nubarashen administrative districts given on May 25, 2010 asking to change it and to give more severe punishment to the five employees of the “Nubarashen” penitentiary.
On May 25, 2010 the Court of First Instance of Erebuni and Nubarashen administrative districts found guilty S. Tamrazyan, the chief of the Life-termers’ Department of the “Nubarashen” penitentiary, S. Artenyan, the head of the Security Provision Division, A. Smbatyan, the senior of the day shift and the employees of the shift V. Haroututyan and A. Atabekyan for official negligence which caused grave consequences.
The court has justified that on November 27, 2009 the life-termers Mher Enokyan and Soghomon Kocharyan managed to escape from the penitentiary as the employees of the “Nubarashen” penitentiary Aghasi Smbatyan, Serzhik Tamrazyan, Sedrak Artenyan, Ara Atabekyan and Vanik Haroutyunyan broke the penitentiary regulations as well as the demands of the order 43-L by the head of the “Nubarashen” penitentiary made on November 9, 2009.
Particularly it has been stated that Mher Enokyan and Soghomon Kocharyan by studying the work carried out by the employees of the penitentiary and making sure that the latter neglected their work, didn’t implement their responsibilities, that is didn’t search the cells properly, didn’t search the prisoners while taking them out of the cells, didn’t conduct technical search of the cells and guard the roofs of the cells, planned an escape from the penitentiary in the summer of 2009. In order to carry out their criminal intentions they obtained parts of saw for cutting metal things from Kim Hayrapetyan a prisoner of the economic division of the penitentiary and kept them in their cell. Then they cut the metal railings of the cell 1 for 3 to 4 months with the parts of the saw. Besides they had a great amount of thread in their cell and not being guarded for a long period of time they wove ropes of 9,5 and 2 meters and on November 27, 2009 at about 5:00 p.m. they escaped through the roof of the cell using the ropes and insulating tapes and passing through the alarm system and over the outer wall. On December 18, 2009, at about 17:45 M. Yenokyan was found on Amiryan-Zakyan crossway in Yerevan and S. Kocharyan at about 23:00 in Mughni village of Aragatsotn region.
The court sentenced S. Tamrazyan, A. Atabekyan, A. Smbatyan and V. Haroutunyan to 2 years of imprisonment and S. Artenyan to 2 years and six months according to the RA Criminal Code Article 315, part 2 for committing official negligence with grave consequences.
However according to the prosecutor the punishments are mild and he has appealed to the Court of Appeal asking to give more severe punishments to the accused persons taking into consideration the nature and degree of social danger.
