The initiation of the criminal case rejected based on the absence of crime

On 8 April, 2012, the parliamentary candidate Anushavan Nikoghosyan reported to the Tashir Division of the Police that on the same day Tashir mayor hindered the placement of advertising posters.

During the preparation of the materials, Anushavan Nikoghosyan mentioned that he had signed an agreement with “EGA” Ltd. on the placement of his pre-election advertising posters on advertising panels belonging to the company in Stepanavan and Tashir towns.

On 8 April, 2012, the employees of the company K. Gogyan and A. Manukyan went to Tashir town and at about 06:00 p.m. K. Gogyan called A. Nikoghosyan and told him that during the placement of the posters, Tashir Mayor Nshan Soghoyan had approached them accompanied by several people, threatened and made them take the posters down.

K. Gogyan and A. Manukyan denied the facts presented by Anushavan Nikoghosyan that Nshan Soghoyan had threatened and forced them to leave the town.

The latter informed that Tashir Mayor Nshan Soghoyan had demanded to present the permission for the placement of the advertisement and related documents. On knowing that there were not appropriate documents, he had proposed to terminate the work and continue it when the documents would be available.

During the investigation it was not proved that Nshan Soghoyan or another person deliberately and illegally hindered the placement of Anushavan Nikoghosyan’s pre-election campaign posters as well as threatened K. Gogyan and A. Manukyan whereas it was proved Tashir Mayor Nshan Soghoyan had carried out his official duties by trying to find out the validity of the poster placement and had not threatened anybody or committed a crime provided by the Criminal Code of the Republic of Armenia.

On 14 April, 2012, the initiation of the criminal case rejected based on the absence of crime.
